In opposition to Elena Kagan, Robert Bork spoke out against her nomination to the highest court in the land. Bork, who was also nominated to the Supreme Court in 1987 by Ronald Reagan, says that Kagan hasn’t had the time to develop a “mature” philosophy on judging.
Says Bork, Kagan has inflated dreams of what Constitutional Law and courts can do. Originally poised to support her, Bork changed his mind after finding out more about Kagan. Specifically her admiration for Judge Aharon Barak who served as Chief Judge for Israel’s Supreme Court; Bork views Barak as a very activist judge.
